General Terms and Conditions of Aquarella
The present General Terms and Conditions aim to regulate the terms and conditions under which Aquarella Piscinas e Jardins, Lda., headquartered at Rua Moinho de Vento, 7 Monfirre, NIPC 510383262 (hereinafter referred to as “Aquarella”) will operate.
The service provided by Aquarella consists of making available and supplying a range of products and/or services, allowing the user, granted the status of a customer, to order and purchase online the products presented therein.
By using Aquarella, you fully accept and agree to all the parameters present in the Terms and Conditions outlined, as well as the Privacy Policy in effect at the time you access Aquarella.
If you do not accept, partially or entirely, any of the stipulated conditions, you should not make any purchases on Aquarella. If you access Aquarella, you commit and agree to comply with the conditions stated on this page and in the Privacy Policy.
Aquarella reserves the right to update and modify the Terms and Conditions without prior notice. It is advisable to periodically check the Terms and Conditions to verify any changes or updates.
Product and Price Information
Aquarella informs customers about the features, descriptions, images, or videos of each product and/or service on each page provided based on information supplied by our partners/suppliers. Aquarella is committed to providing its products and/or services clearly and to correcting any errors that may occur as quickly as possible.
Aquarella presents, in a concise manner, the prices of each product and/or service, including VAT, shipping fees applied to each order, and other additional costs that may apply.
Information about products, prices, content, images, videos, promotional campaigns, and services may be updated and changed by Aquarella at any time.
Intellectual Property
Aquarella is a registered online store, with the service being provided by Aquarella Piscinas e Jardins, Lda.
The content, domain, and information provided and available on Aquarella are the property of Aquarella Piscinas e Jardins, Lda. or have been granted to it and are therefore protected by copyright and related rights. Any use, reproduction, copying, or disclosure of visual, audiovisual, or written content is subject to prior approval by Aquarella.
The customer agrees to fully respect the conditions and rights mentioned, as well as to refrain from actions that may violate the law and rights such as copyright, related rights, and other applicable legislation regarding the use of images, videos, content, etc., without express approval from Aquarella. Aquarella will not be held responsible for any improper use of such products.
Payment Methods
Aquarella provides the following payment methods:

After payment is completed, Aquarella will perform a standard verification in order to process and ship the order. The customer will receive an email confirming that the order has been paid for, along with the corresponding invoice.
Purchase Conditions on Aquarella:
Product Availability
The availability of the equipment advertised in the Aquarella store depends on the stock availability from our partners/suppliers.
If after completing the purchase, a particular product is unavailable, Aquarella commits to contact the customer by phone or email as soon as possible in order to expedite the process with them.
If the customer wishes to avoid the inconvenience of stockouts and/or delivery delays, they may and should contact the support line available on the homepage and the Contacts page, or send an email to encomendas@aquarella.pt to confirm the stock availability of the desired product and shipping times before completing the order.
Fees and Taxes
Prices presented on Aquarella are in Euros, with the applicable VAT and taxes according to the law in effect, which are already included in the displayed price.
Order Cancellation
The customer may cancel an order while it is still being processed. It is requested that they inform Aquarella through the following email contact: encomendas@aquarella.pt.
If the cancellation request is made after the order has been dispatched, it will be forwarded for delivery, and the customer may choose to refuse the order upon delivery. Aquarella is not responsible for any delays in the processing of order cancellations.
Aquarella reserves the right not to process orders or refunds in cases of data inconsistencies, fraud, or misconduct by the customer, as well as for technical issues unrelated to Aquarella.
Right of Withdrawal
The customer has the right to withdraw from the contract within 14 (fourteen) days from the date of the contract.
If the customer wishes to cancel the contract, they can do so by email at encomendas@aquarella.pt or by filling out the contact form available on Aquarella.
When canceling the contract within the legal period, in addition to returning the product, the customer must return any offers that accompany the main product. Aquarella must refund the amount paid within a maximum of 14 days after receiving the returned order, accompanied by the purchase invoice, proof of payment, and the return form.
The refund will be processed using the same payment method used by the customer for the initial payment, unless expressly agreed otherwise, and the customer will not incur any costs as a result of the refund.
Any refund procedures will be processed as provided in the applicable legislation under Decree-Law No. 24/2014.
Complaints
The customer may submit a complaint regarding any matter, act, information, or service provided by Aquarella through the email contact encomendas@aquarella.pt or through the electronic Complaints Book available at the following link: https://www.livroreclamacoes.pt/Inicio/.
Liability Disclaimer
By creating and using an account on Aquarella, the customer is responsible for maintaining the account, confidentiality, and all activity arising from their account.
By creating a user account and placing orders, the customer expressly and unequivocally accepts the Terms and Conditions in their most current version.
Aquarella is not responsible for any information disclosed by third parties, technical failures, or any other issues that prevent access to or proper functioning of the online store.
Aquarella is not liable for any direct or indirect damages related to the use, or inability to use, the products and/or services provided, nor for any delays or unforeseen issues in the delivery of orders.

This contract is subject to Portuguese law and the applicable legislation in force.
